PANYNJ is a bi-state agency. The jurisdictional rules matter and most lawyers get them wrong.
TL;DR
- The Port Authority of New York and New Jersey is a bi-state agency. PA workers’ compensation is administered under the Port Authority Workers’ Compensation system, not directly under the NY WCB — but NY law substantively applies in many circumstances.
- Port Authority Police Department officers receive line-of-duty benefits in addition to WC coverage.
- Common claims include airport facility injuries (JFK, LGA, Newark), bridge and tunnel injuries, PATH-related injuries, and bus terminal injuries.
- The jurisdictional and procedural rules are different enough that generalist WC counsel routinely misroutes these cases.
Who this page is for
- Port Authority Police Department (PAPD) officers and supervisors
- PATH employees (operating and maintenance)
- Airport operations staff at JFK, LaGuardia, Newark
- Bridge and tunnel operations staff (GWB, Lincoln, Holland, Bayonne, Outerbridge, Goethals)
- Bus terminal operations staff (Port Authority Bus Terminal, GWB Bus Station)
- PA civilian staff across all facilities
The bi-state jurisdictional wrinkle
PANYNJ was created by interstate compact. Its workers’ compensation system is administered through a Port Authority WC program governed by the WC laws of both states, with substantive law typically applied based on the place of injury or the employee’s primary work location.
For a PAPD officer injured in the Lincoln Tunnel, the case may be processed under NJ WC. For one injured at JFK, NY WC. For PATH operating personnel, the rules can be complicated further by which state the train was in at the time of injury — though this is rarely outcome-determinative.
What this means practically: representation needs to be capable in both NY and NJ procedure, or coordinated with co-counsel admitted in the relevant state.
PAPD officers
PAPD officers receive line-of-duty injury benefits through PA’s internal framework, with PA pension disability through the PAPD pension system. The benefit coordination is its own subject:
- Line-of-duty salary continuation runs alongside WC, with the PA crediting WC indemnity
- Disability retirement through PAPD’s plan has accidental and ordinary pathways
- Federal-state interplay can affect SSDI eligibility
Common Port Authority injury patterns
- Airport injuries — ramp accidents, vehicle/equipment incidents, slip/trip in terminals, assaults
- Bridge and tunnel maintenance injuries — confined space, fall from height, traffic exposure
- PATH operating injuries — train operator and conductor injuries, station agent injuries, track work
- Bus terminal incidents — fare disputes, assaults, slip/trip
- PAPD line-of-duty injuries — restraint, assault, vehicle pursuit, terrorism-response training
9/11 / WTC-related claims
PA workers who responded to or worked at the World Trade Center site post-9/11 may have qualifying claims under the WTC presumption frameworks. PAPD officers were among the largest first-responder agency present. If you responded and have qualifying conditions developing now, registration and claim filing are time-critical.
